Document Retention and Destruction Policies
The Electronic Discovery Amendments to the Federal Rules of Civil Procedure took effect on December 1, 2006. Lawyers operate under these rules when prosecuting or defending litigation in federal court. These amendments will have an enormous impact on employment litigation.
Because of these new rules, all companies should consider adopting a lawful document retention and destruction policy. A sound policy will have in it at least three important benefits:
- the retention of necessary data pursuant to various laws, business needs and litigation holds, and the destruction of unnecessary data, should limit the cost of discovery if you are involved in litigation because less data will exist that will have to be searched and reviewed;
- courts are more likely to view the destruction of documents more favorably when done pursuant to a policy and routine timeline; and,
- a written policy will emphasize that destruction of documents (including electronic data) relevant to foreseeable or pending litigation must cease immediately upon notice of any such litigation (i.e., a “litigation hold”) (of course, destruction of documents must cease immediately if they are relevant to anticipated or pending litigation).
